Navigating the New EU and US Rules on Pay Equality, Transparency and Working Hours

Paying employees has become increasingly complex for employers in the United States and Europe alike.  There has been increased public awareness of pay equity, particularly gender-based pay equity issues, and such awareness has increase legislation, particularly at the state and local levels, designed to promote pay equity.  Moreover, as various wage laws are construed in favor of employees, employers are often faced with legal challenges to pay systems and compensation plans that were actually designed to benefit employees, but which are not in compliance with the strict laws.

Discussion topics will include:

Pay Equity
 Equal Pay Act
 Title VII of the Civil Rights Act of 1964
 Executive Order 1146/Office of Federal Contract Compliance Programs
 Analogous State and City Laws

Salary Transparency
 States and Cities have increasingly been active in passing legislation designed to promote equal pay by requiring or prohibiting conduct designed to eliminate gender-based pay disparities. Such legislation includes
 Requirements to list salaries/wages in job postings
 Requirements to provide salary ranges upon request
 Pay compliance reporting
 Prohibition on inquiring about and/or using prior salary information
Laws promoting voluntary self-audits of compensation.

Wage and Hour Laws
 The Federal Fair Labor Standards Act and similar State laws required the payment of an overtime premium for all employees, other than employees who fall into narrowly construed exemptions including:
> Executive
> Administrative
> Professional (including “creative” professionals)
> Computer Systems
> Outside Sales
 State and Local laws further complicate matters by having carious requirements as to:
> Pay frequency
> Pay stub language
> Deductions
> Other notice/posting requirements
 The law are construed narrowly and in favor of employees, and pose significant potential for employers
